Terms of Service

These Terms of Service ("Terms") govern your use of the SchoolMemories platform ("Service"), operated by SchoolMemories, a business registered in Vijayapura, Karnataka, India (Udyam Registration No. UDYAM-KR-07-0004384). By using the Service, you agree to these Terms.

1. The Service

SchoolMemories is a school-photography platform. Schools upload event photos; AI face matching helps each parent find and receive photos of their own child, delivered in the app and (with consent) over WhatsApp, email, and web push. The Service is intended for educational institutions and the parents/guardians of their students in India.

2. Definitions

• "School Admin" — the person who registers a school and manages events, staff, and settings.
• "Staff" — teachers and other authorized personnel who upload event photos.
• "Parent" — a parent or legal guardian who accesses the Service to find their child's photos.
• "Keepsake" — an optional one-time purchase to keep full-resolution, watermark-free photos, or a physical keepsake such as a framed print.

3. Eligibility & Accounts

• You must be at least 18 years old to create a school account. Parents must be the legal guardians of the children whose photos they access.
• School Admins are responsible for their school's account, including authorizing staff and providing accurate information.
• You are responsible for the security of the Google account used to sign in.
• We may suspend or terminate accounts that violate these Terms.

4. School Responsibilities

• You must have proper authorization to upload event photos.
• You confirm the school has obtained the necessary parental consent for photographing children at school events and for processing their photos through the Service.
• Roster data (including parent contact details) you provide must be accurate and lawfully collected.

5. Parent Responsibilities

• You confirm you are the parent or legal guardian of the child whose reference photo you provide.
• You will use the Service only to access your own child's photos, and you will keep your access link/account private.

6. Photo Content & Copyright

You retain ownership of photos you upload. By uploading, you grant SchoolMemories a limited, non-exclusive licence to process, store, watermark, and deliver them through the Service. This licence ends when you delete the photos or your account. You may not upload content that is unlawful, infringing, harmful, or that contains malware.

7. AI Face Matching

• Face matching is automated and may not be 100% accurate; false or missed matches can occur, and we are not liable for inaccuracies.
• Parent selfies used to search are processed in real time and not stored after matching.
• Faceprints (mathematical representations, not photos) are stored to enable matching and can be erased on request.

8. Pricing

• SchoolMemories is free for schools — no platform fee, no per-event charge.
• Parents view and share their child's photos for free. Full-resolution, watermark-free downloads and physical keepsakes (such as framed prints) are optional one-time purchases.
• There are no ads.

9. Payments & Refunds

Optional keepsake purchases are processed securely by Razorpay. Because digital downloads are delivered instantly, digital purchases are generally non-refundable once delivered, except where required by law. Physical keepsakes follow the delivery and returns terms shown at checkout. Pricing may change with notice.

10. Acceptable Use & Security

You may not attempt to reverse-engineer, scrape, overload, or bypass the security of the Service, access data belonging to other schools or families, or use the Service to harass or harm anyone. Violations may result in suspension or termination.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as-is" without warranties of any kind.
• We are not liable for indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
• We are not responsible for data loss due to school account deletion or school-initiated photo removal.

12. Termination

• Schools can delete their account at any time; photos, events, and faceprints are permanently deleted within 30 days.
• Upon termination, your licence to use the Service ends immediately.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Vijayapura, Karnataka.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 15 days before they take effect. Continued use after changes constitutes acceptance.
