Terms of Service

These Terms of Service ("Terms") govern your use of the SchoolMemories platform ("Service") operated by SchoolMemories ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Definitions

"School Admin" — The person who registers a school and manages events, staff, and settings.
"Staff" — Teachers and other authorized personnel who upload event photos.
"Parent" — A parent or guardian who accesses event pages to find their child's photos.
"Event" — A school event (e.g., Annual Day, Sports Day) with associated photos.
"Premium Subscription" — A paid plan granting access to full-resolution photos without watermarks.

2. Eligibility

You must be at least 18 years old to create a school account. Parents must be legal guardians of the children whose photos they access. The Service is intended for use by educational institutions in India.

3. Accounts

School Admins are responsible for managing their school's account, including authorizing staff members.
You must provide accurate information when registering.
You are responsible for maintaining the security of your Google account used to sign in.
We reserve the right to suspend accounts that violate these Terms.

4. Photo Uploads & Content

School Staff Responsibilities

You must have proper authorization from your school to upload event photos.
Photos must be from legitimate school events. Inappropriate, offensive, or illegal content is strictly prohibited.
You confirm that the school has obtained necessary consent from parents for photographing children at school events (as per your school's existing policies).

Copyright

You retain ownership of all photos you upload. By uploading photos, you grant SchoolMemories a limited, non-exclusive license to process, store, watermark, and distribute them through the Service. This license ends when you delete the photos or your account.

Prohibited Content

You may not upload content that:

Violates any applicable law.
Contains nudity, violence, or other harmful material.
Infringes on intellectual property rights.
Contains malware or harmful code.

5. AI Face Matching

Our Service uses AI-powered face matching to help parents find their child's photos. By using this feature:

You acknowledge that face matching is automated and may not be 100% accurate.
False matches or missed matches may occur. We are not liable for inaccuracies.
Parent selfies are processed in real-time and not stored after matching.
Face embeddings (mathematical representations, not actual photos) are stored to enable matching.

6. Premium Subscriptions

Premium subscriptions cost ₹499/year per child.
Premium access includes: watermark-free photos, full-resolution downloads, and bulk download.
Subscriptions are non-refundable once activated, except where required by law.
Pricing may change with 30 days' notice.

7. Free Tier for Schools

Schools can use the platform free of charge. The free tier includes:

Unlimited event creation.
Photo uploads with automatic AI face indexing.
Shareable event links for parents.
Watermarked photo previews for free-tier parents.

We reserve the right to introduce usage limits or paid tiers for schools in the future, with prior notice.

8. Watermarks

Photos viewed by non-premium parents will include a visible watermark. Attempting to remove, circumvent, or bypass watermarks is a violation of these Terms and may result in account suspension.

9. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "as-is" without warranties of any kind.
We are not liable for any indirect, incidental, or consequential damages.
Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
We are not responsible for data loss due to school account deletion or school-initiated photo removal.

10. Termination

Schools can delete their account at any time. All photos, events, and face embeddings will be permanently deleted within 30 days.
We may suspend or terminate accounts for Terms violations.
Upon termination, your license to use the Service ends immediately.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 15 days before they take effect. Continued use after changes constitutes acceptance.
